Welcome to Gemeos Trading Inc. (“we,” “us,” or “our”). By accessing and using our website and services, including our copy trading platform, you (“you” or “the Client”) agree to abide by the terms and conditions set forth in this Terms of Service (“Agreement”). If you do not agree with these terms, please do not use our services.

1. Introduction

Gemeos Trading Inc. provides a copy trading software that allows clients to replicate the trading strategies of experienced traders via our platform. However, please note that we are not a financial institution, and we do not offer personalized financial advice, investment recommendations, or portfolio management services.

2. No Financial Advice

  • Non-Financial Institution: Gemeos Trading Inc. is not a licensed financial advisory firm, broker-dealer, or registered investment advisor. We are a technology and software provider.
  • No Financial Advice: The content provided through our services, including any trading strategies, information, or tools, is for informational purposes only and should not be construed as financial advice or a recommendation to make any financial decisions. Any examples shown in marketing content or on our website is not to be construed as financial advice and are only examples of copy trading.
  • Risk Acknowledgment: All investments and trading carry inherent risks, and clients are solely responsible for any financial decisions or trades they make using our platform. We encourage you to seek independent financial advice from a qualified professional before making any investment decisions.

3. Limitations of Liability

  • No Liability for Losses: Gemeos Trading Inc. shall not be held liable for any financial losses, damages, or any other negative outcomes that result from your use of our copy trading softwares. By using our platform, you acknowledge and accept the risk of trading and fully understand that past performance does not guarantee future results.
  • No Guarantee of Profit: While we aim to provide valuable and effective trading software systems, we do not guarantee profits. The success or failure of any trade or investment made through our software or platform depends on a variety of factors, including market conditions, timing, and other unpredictable variables.

4. Account Registration

To use our software, you must create an account and follow the instructions set out by our customer service and provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized use of your account.

5. Subscription and Payments

  • Subscription Fees: Our software services are available on a subscription basis. You agree to pay the applicable fees for the services you select.
  • Non-Refundable Fees: As outlined in our Refund Policy, setup and recurring monthly fees are non-refundable once paid.
  • Payment Processing: Payments for subscription fees are processed by third-party payment processors. We are not responsible for any issues or disputes related to payments or payment processing.

6. Use of Our Platform

  • Eligibility: You must be at least 18 years of age or the age of majority in your jurisdiction to use our software. By using our platform, you confirm that you meet this age requirement. You will choose brokers and other actual trading platforms, in no conjunction with Gemeos as we are not a broker platform, do not recommend any brokers, and only provide copy trading software.
  • Prohibited Activities: You agree not to engage in any unlawful activities while using our platform, including but not limited to fraud, misrepresentation, or tampering with the service.
  • Platform Access: We reserve the right to modify, suspend, or terminate access to our platform at any time, without notice, for reasons including maintenance, security, or violation of these terms.

7. Privacy and Data Collection

Your use of our platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using our services, you consent to the collection and processing of your data as outlined in the Privacy Policy.

Your continued use of our platform after any changes indicates your acceptance of the updated terms.

10. Termination of Service

  • User Termination: You may terminate your subscription at any time by following the cancellation instructions provided in your account settings. Termination will take effect at the end of the current billing cycle, and no refunds will be issued for the current period.
  • Company Termination: We reserve the right to suspend or terminate your account or access to our services if you violate these Terms of Service, engage in unlawful activities, or breach any applicable laws or regulations.

11. Dispute Resolution and Governing Law

  • Arbitration: Any disputes or claims arising out of or relating to this Agreement, or your use of our services, shall be resolved through binding arbitration, and for software fees only, rather than in court, except where prohibited by applicable law. Any issues that may arise with brokers you choose or losses with trading systems are your responsibility.
  • Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles.
